Terms of Service
These Terms govern your use of Daff App, including public browsing, account features, photo contributions, public media, vendor links, and the public API.
1. Acceptance of Terms
By using daff.app, creating an account, uploading a photo, or using the public API, you agree to these Terms. If you do not agree, do not use Daff App. Some features, including photo uploads, require additional action such as accepting the current photo license terms.
2. Operator
Daff App is currently operated by Connor DeLoach as an individual project. "Daff App," "we," "us," and "our" mean Connor DeLoach as the current operator of Daff App and any successor entity that later operates the service.
Daff App is not currently presented as an LLC or corporation. We may transfer or assign the service, these Terms, accounts, content licenses, operational rights, and related data to a future legal entity, successor, or assignee that continues operating Daff App.
3. Service Changes and Availability
Daff App features may change, break, be limited, pause, or be removed. Account creation and uploads may be opened, closed, or restricted. API access may change, become rate-limited, require keys, or be discontinued.
We do not guarantee uptime, review time, publication, record completeness, record accuracy, API continuity, or continued feature availability.
4. Eligibility
Public browsing is generally available without an account. You must be at least 18 years old to create an account or upload photos. You may not create an account, upload content, or use Daff App if applicable law prohibits you from doing so.
5. Accounts
Authentication is provided through WorkOS/AuthKit. Daff App does not directly manage your password. You are responsible for maintaining control over your account access and for activity under your account.
Current account features are intentionally limited. They may include signed-in status, account email, display-name editing, and contribution readiness. We may suspend, restrict, or delete accounts for violations, abuse, security concerns, repeat infringement, or legal reasons.
6. Display Names and Attribution
You must choose a display name before uploading photos. Display names are used for public attribution of accepted and published photos. Display names are not unique and may be legal names, pseudonyms, organization names, or garden names.
Email addresses and authentication IDs are not intended to be public attribution names. If you change your display name later, existing attribution may not update automatically. We may correct, hide, or adjust display names that are abusive, misleading, infringing, impersonating, or otherwise unsuitable.
7. Photo Uploads
Signed-in active users may be allowed to upload photos associated with a daffodil record. Current accepted formats are JPEG, PNG, and WebP. The current maximum file size is 8 MB, and the current upload form accepts one photo per upload.
Uploading does not guarantee publication. Pending uploads are private and are not publicly visible. Accepted public renditions may appear on daffodil detail pages, galleries, lightboxes, public media URLs, and related public pages.
8. User Promises About Uploaded Photos
When you upload a photo, you promise that:
- you took the photo yourself or have all rights and permissions needed to upload it;
- you have the right to license the photo under CC BY 4.0 if it is published;
- the photo does not infringe copyright, trademark, privacy, publicity, contract, or other rights;
- the photo is not copied from a catalog, vendor site, social media post, book, database, search engine, or other source unless you have permission to license it under CC BY 4.0;
- the photo does not include illegal, abusive, misleading, spam, malware, harmful, privacy-violating, or non-daffodil content;
- the photo does not intentionally misrepresent the cultivar, source, owner, or subject.
9. CC BY 4.0 License for Published Photos
When you upload a photo and accept the upload license, you authorize Daff App to publish accepted photos under Creative Commons Attribution 4.0 International. CC BY 4.0 allows others to copy, share, redistribute, adapt, and use the photo, including commercially, as long as they provide required attribution and follow the license.
The public CC BY 4.0 license generally cannot be revoked for copies already shared under the license. Daff App may remove a photo from the site, but removal does not revoke rights already granted to the public or prevent third parties from using copies they already received under the license.
10. Operational License to Daff App
In addition to the public license for published photos, you grant Daff App the rights needed to operate, secure, moderate, document, and legally protect the service. This includes the right to:
- receive, store, copy, back up, secure, and process uploaded files;
- create resized, compressed, cropped, transformed, or format-shifted renditions;
- display accepted renditions publicly and cache them through hosting and CDN infrastructure;
- associate photos with cultivar records and add attribution, license, caption, credit, source, and review metadata;
- classify photos by subject, view, confidence, and suitability;
- use automated, AI-assisted, human, or combined review workflows;
- moderate, reject, hide, unpublish, remove, or purge content;
- respond to copyright, abuse, privacy, security, and legal requests.
11. Review and Moderation
All uploads may be reviewed before publication. Review may be automated, AI-assisted, human, or a combination. Review may classify subject, view, confidence, quality, and suitability.
Daff App may accept, reject, hide, remove, unpublish, modify metadata, correct classifications, or refuse publication for any reason. Publication does not mean Daff App guarantees legal ownership, cultivar accuracy, botanical accuracy, or image correctness. Operators, moderators, admins, and service systems may access private originals and metadata as needed for review, security, legal, abuse, and operational purposes.
Daff App may reject photos with visible watermarks, logos, promotional text, signatures, date stamps, decorative borders, or embedded branding even when the uploader owns or controls the photo. Public attribution is handled separately through Daff App attribution fields. Clean, unmarked photos are preferred for public cultivar reference pages.
12. Removal of User Content
You may contact Daff App to withdraw a pending upload before it is accepted and published. After a photo is accepted and published, you may request correction, replacement, removal, unpublishing, or removal of attribution information. Daff App will review these requests, but unless action is legally required, Daff App may decide whether to remove, hide, unpublish, retain, replace, continue displaying, or modify attribution for the content.
Submitting a better photo does not guarantee removal of an earlier published photo. Daff App may keep, replace, or unpublish photos based on quality, accuracy, usefulness, moderation, legal, and operational needs.
Removal, replacement, unpublishing, or attribution changes do not revoke the CC BY 4.0 license already granted to Daff App or to the public, and Daff App cannot control third-party copies of photos that were already made public.
Daff App may retain uploaded files, public renditions, metadata, moderation records, copyright records, audit logs, security logs, backups, and related records as needed for service operation, legal compliance, abuse prevention, copyright handling, security, and recordkeeping.
13. Prohibited Conduct
- uploading content without rights or permission;
- uploading non-daffodil spam, misleading files, malware, or corrupted files;
- impersonation or false attribution;
- abusive, harassing, obscene, illegal, or privacy-violating conduct;
- attempts to exploit upload handling, bypass authentication, review, moderation, rate limits, or security controls;
- scraping private or account-only areas;
- overloading the public API or site;
- using Daff App in a way that violates law or third-party rights;
- falsely implying endorsement by Daff App.
14. Public Reference Data
Daff App provides cultivar, citation, source, hybridizer/person, parentage, children, similar-cultivar, photo, and vendor-reference information. Data may be incomplete, incorrect, outdated, disputed, merged, removed, corrected, or reorganized. Daff App is a reference tool, not an authoritative horticultural, botanical, scientific, commercial, or legal authority.
15. Public API and Automated Access
Daff App may provide public read-only API endpoints. API users must follow the API & Automated Access Policy. We may rate-limit, block, throttle, change, or discontinue API access.
Public content may be indexed or analyzed by search engines, bots, and AI systems, subject to applicable law, applicable licenses, and access policies. Automated access must not impair the service, bypass controls, or access private data.
16. Vendor Links and Third-Party Sites
Daff App may show third-party vendor offers and outbound links. Daff App does not sell bulbs, process purchases, fulfill orders, or control vendor sites. We do not guarantee price, stock, availability, shipping, cultivar accuracy, quality, vendor performance, or transaction outcomes. Verify purchase details directly with the vendor.
17. Copyright Complaints
Daff App respects copyright. Copyright complaints should be sent to copyright@daff.app. See the Copyright & DMCA Policy for notice and counter-notice procedures. Daff App may remove or disable access to allegedly infringing material, and repeat infringers may have accounts restricted or terminated.
18. Privacy
Use of Daff App is also governed by the Privacy Policy, which explains what information Daff App collects, uses, shares, stores, and makes public.
19. Disclaimers
Daff App is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim warranties of accuracy, completeness, reliability, availability, review, publication, storage, vendor accuracy, API continuity, non-infringement of user-submitted photos, and correct identification of submitted images.
20. Limitation of Liability
To the fullest extent allowed by law, Daff App is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost data; vendor transaction issues; third-party reuse of CC BY photos; API downtime; or reliance on inaccurate information. Daff App's total liability for any claim is limited to USD $100 or the lowest amount allowed by applicable law, whichever is greater.
21. Indemnity
You are responsible for claims arising from your uploaded content, rights violations, misuse of the service, breach of these Terms, or unlawful conduct. This especially includes claims that you lacked rights to upload or license a photo.
22. Suspension and Termination
Daff App may suspend, restrict, or terminate accounts for violations, legal concerns, security issues, abuse, or repeat infringement. You may stop using the service or request account deletion. Content licenses, operational rights, disclaimers, liability limits, indemnity, and legal/audit retention provisions survive termination as needed.
23. Changes to Terms
We may update these Terms. Updated Terms will show a new effective or last updated date. Material changes may be announced on the site or through account/email notice if practical. Continued use after changes means acceptance. Material changes to upload/license terms may require fresh acceptance before future uploads.
24. Governing Law
Florida law governs these Terms, without regard to conflict-of-law rules. Venue will be in appropriate state or federal courts in Florida unless applicable law requires otherwise.
